Ordering and delivery
To make a purchase, the selected goods must be added to the shopping cart and then the purchase must be paid for either via a payment gateway or by bank transfer. Orders are accepted only through the e-shop.
The terms and conditions apply to PotiTomat OÜ (hereinafter the “Seller”), Estonian reg. code 14531497, for purchase and sale agreements for goods ordered in the online store at www.potitomat.ee (hereinafter in the singular “Agreement”), which is entered into between the seller and the natural person ordering the goods (hereinafter “Buyer”) during the validity of these terms.
This version of the order conditions is valid from 09.02.2022.
2. ENTRY INTO FORCE OF THE AGREEMENT
The customer's order is generally considered to be a contract for the purchase and sale of the ordered goods. The seller accepts the order if he issues an invoice to the customer and the customer pays according to the issued invoice. If the customer has not paid for the order within 3 days after submitting the order, the order will end after 3 days. The Seller agrees to enter into the Agreement only with an adult natural person.
3. DEADLINE FOR COMPLETION OF THE ORDER
The Seller shall fulfill the order (deliver the goods or make them available at the Seller's location) no later than within 14 days of payment of the invoice, but the change of seasons shall be taken into account. The Seller shall deliver the ordered products to the Customer no later than the time when the natural time is the best time to plant them, taking into account the natural conditions. The Seller shall notify the Buyer of the later delivery time as soon as possible. The delivery time of the ordered goods is according to the availability of specific goods.
Tomato plants shall be received or delivered during the second and third weeks of May, unless otherwise agreed.
Self-picked orders will be picked up by the date stated when ordering or when announced by customer. If the Buyer wishes to pick up the order on the day of ordering or announces the time of pick-up on the same day or the previous day after 19:00, an express order fee of 15 € will be added.
4. REPLACEMENT PRODUCTS AND REPLACEMENT
The seller has the right to replace the purchased plants with equivalent or similar ones, if necessary, provided that the total price of the plants offered for replacement is not less than the total price of the plants to be replaced. The seller offers as close as possible (height, fruit color, yield) or better plants as a replacement.
5. PRICE AND METHODS OF PAYMENT
The prices on www.potitomat.ee are in euros and do not include valid VAT, as the Seller is not subject to VAT.
We use the services of EveryPay AS or Maksekeskus AS to process payments.

- Estonia: Swedbank, SEB, LHV, Luminor, Coop
- Latvia: Swedbank, SEB, Citadele and Luminor
- Lithuania: Swedbank, SEB, Luminor and Siauliu Bankas (with payment initiation service).

You cannot pay for the goods in cash.
PotiTomat OÜ is the master processor of personal data. The company transmits the personal data necessary for making payments to the authorized processors Maksekeskus AS or EveryPay AS according to the chosen payment method.
6. DELIVERY OF GOODS
The seller is obliged to deliver the ordered goods in Estonia, Finland, Latvia, and Lithuania.
The ordered goods will be delivered to the Customer using the courier service (Itella Smartkuller, DPD, Raider Trans, etc.) or we will deliver the goods ourselves. By prior agreement, it is possible to pick up the ordered goods yourself at Jaama 17, Käru alevik, Türi vald, Järvamaa.
The time and day of delivery requested by the buyer is recommended and its availability depends on the courier's transport schedule.
The cost of assembling and packing the goods is 5 €. In the case of transport, the transport fee also includes the packaging fee.
The transport fee in Estonia is 15 €. The transport fee in Latvia is 18 €. The transport fee in Lithuania is 20 €. The transport fee in Finland is 25 €.
7. RIGHT OF THE CUSTOMER TO WITHDRAW THE ORDER The
Customer has the right to withdraw from the purchase and sale agreement entered into on the basis of the order without giving reasons within 14 days from the delivery of the ordered goods to the Customer. In order to withdraw from the contract, the Customer must make a corresponding application to the Seller and then return the goods ordered to the Seller. Return of the ordered goods to the seller within the specified term is also considered to be withdrawal from the contract. The seller shall not bear the cost of transporting the ordered goods from the seller to the customer upon withdrawal from the contract.
The Customer has no right to withdraw from the purchase and sale agreement entered into on the basis of the order if:
the ordered goods were grown taking into account the Customer's personal needs or in accordance with the conditions submitted by the Customer;
the ordered goods cannot be returned due to their nature, which are perishable or which have expired;
The returned goods must not have been used. If the thing to be returned has deteriorated and the deterioration has not occurred as a result of regular use of the thing, the Customer shall compensate for the decrease in the value of the thing.
8. INSTRUCTIONS FOR WITHDRAWAL FROM THE AGREEMENT AND RETURN OF THE GOODS
The goods will be returned to the e-mail email@example.com after receipt of the application and then the Seller will give further instructions.
9. THE SELLER'S RIGHT TO WITHDRAW FROM THE CONTRACT
The Seller has the right to withdraw from the purchase and sale agreement entered into on the basis of the order if the Seller's stocks of the respective goods have been exhausted. The same applies if the order was placed by a person who was not entitled to do so under these terms and conditions.
10. RETURN OF MONEY ON WITHDRAWAL FROM THE CONTRACT
The Seller shall return the price paid for the returned goods to the Customer immediately, but no later than within 30 days from the withdrawal from the purchase and sale agreement to the bank account indicated by the Customer. There is no refund for the transport service.
The price that the Customer has received from the use or possibility of using the goods (= the rental price of comparable goods on the free market) shall be deducted from the price of the returned goods.
11. WARRANTY CONDITIONS
The seller gives a growth guarantee of up to 2 years for the ordered plant, provided that the plant has been properly cared for. The growth guarantee does not extend to cold-sensitive plants, annual plants, seeds, etc. The growth guarantee does not apply if the Customer has taken incorrect care of the ordered plants.
Unless otherwise provided, the Contracting Authority has the following rights pursuant to the growth guarantee: The Contracting Authority has the right to demand, at its option, the replacement of a defective plant with a similar defect-free new plant. The growth guarantee does not entitle the Customer to a refund for the plant ordered. The warranty does not apply if the defect is due to improper use, maintenance or normal wear and tear.
In any case, the warranty is valid only with the purchase invoice.
12. RESERVATION OF OWNERSHIP
Until full payment for the goods, the goods are the property of the Seller.
13. COLLECTION AND USE OF PERSONAL DATA
The Seller has the right to collect the personal data disclosed by the Customer to the Seller and, if necessary, to disclose them to a third party in order to fulfill the order. The Seller has the right to disclose the Customer's personal data to a third party if this is necessary for the collection of claims arising from the Agreement, including to a legal adviser and a court. The Subscriber has the right to prohibit the collection and use of his / her personal data at any time, unless it is necessary for the collection of a claim arising from the Agreement or for the performance of the Agreement.
14. LIMITATION OF LIABILITY
The Seller shall be liable for the damage caused to the Customer by the breach of the purchase and sale agreement concluded on the basis of the order only if the damage was caused by the Seller's intent or gross negligence or if the Customer's health or death was caused. This is without prejudice to the manufacturer's statutory liability.
15. FINAL PROVISIONS
Estonian law applies to these order conditions and the Seller's purchase and sale agreements. If any provision of the order conditions is void, the validity of the rest of the order conditions or the sales contract shall not be affected. An invalid provision is replaced by the legal provision that is legally and economically closest to the invalid provision.
